Below are the votes from the closed session meeting of the BOPC on May 23, 2023:

Following a motion by Commissioner Dean, and a second by Mayor Lucas, at 11:40 a.m., the Board voted to go into closed session to discuss litigation matters, personnel matters, and labor negotiations. The vote was 5-0 in favor. Following polling, Commissioner Tolbert voted Aye, Commissioner Dean voted Aye, Commissioner Cramer voted Aye, Commissioner Whittaker voted Aye, and Mayor Lucas voted Aye.

Following a motion by Commissioner Dean, and a second by Mayor Lucas, the Board voted to authorize certain settlement authority in the case of Mack Nelson v. P.O. Frazier, et al., in an amount not to exceed $___.^[1] The vote was 5-0 in favor. Following polling, Commissioner Tolbert voted Aye, Commissioner Dean voted Aye, Commissioner Cramer voted Aye, Commissioner Whittaker voted Aye, and Mayor Lucas voted Aye.

Following a motion by Commissioner Dean, and a second by Mayor Lucas, the Board voted to grant the duty related disability retirement application of ___________.[2] The vote was 5-0 in favor. Following polling, Commissioner Tolbert voted Aye, Commissioner Dean voted Aye, Commissioner Cramer voted Aye, Commissioner Whittaker voted Aye, and Mayor Lucas voted Aye.

Following a motion by Commissioner Dean, and a second by Mayor Lucas, the Board voted to grant the duty related disability retirement application of ___________.[3] The vote was 5-0 in favor. Following a motion by Commissioner Dean, and a second by Mayor Lucas, the Board voted to approve the applications for continued employment of Sergeant Dani Russell, Sergeant Herbert Robinson, and Reserve Police Officer Don Smarker. The vote was 5-0 in favor. Following polling, Commissioner Tolbert voted Aye, Commissioner Dean voted Aye, Commissioner Cramer voted Aye, Commissioner Whittaker voted Aye, and Mayor Lucas voted Aye.

Following a motion by Mayor Lucas and a second by Commissioner Dean, the Board voted to approve the minutes of the closed Board meeting on April 25, 2023. The vote was 5-0 in favor. Following polling, Commissioner Tolbert voted Aye, Commissioner Dean voted Aye, Commissioner Cramer voted Aye, Commissioner Whittaker voted Aye, and Mayor Lucas voted Aye.

Following a motion by Mayor Lucas and a second by Commissioner Tolbert, at 12:40 p.m., the Board voted to go into special closed session to discuss legal matters. The vote was 5-0 in favor. Following polling, Commissioner Tolbert voted Aye, Commissioner Dean voted Aye, Commissioner Cramer voted Aye, Commissioner Whittaker voted Aye, and Mayor Lucas voted Aye.

Following a motion by Commissioner Dean and a second by Mayor Lucas, the Board voted to come out of closed session and adjourn. The vote was 5-0 in favor. Following polling, Commissioner Tolbert voted Aye, Commissioner Dean voted Aye, Commissioner Cramer voted Aye, Commissioner Whittaker voted Aye, and Mayor Lucas voted Aye.

The Board adjourned at 12:40 p.m.
