Failure to Return Rented/Leased Vehicles/Property Questions
Question: My business rented a vehicle/property. Now we can’t get the property back. What should we do?
Answer: First, send a demand letter to the renter. The letter should indicate that the renter is instructed to return the rented property within ten (10) days. Send the letter certified by the US Mail. This requires the recipient sign for the letter. Make copies of the letter, envelope, and keep the original contract as evidence. These items are mandatory to prove the intent, by the renter, to not return the item as contractually agreed upon in the contract. If after ten (10) days the items have not been returned complete a “Failure To Return Leased/Rented Property” offense report.
